Travel Insurance and Traveller Responsibility Policy

1. Purpose And Scope

1.1 This Policy explains the role of travel insurance in connection with services sold or arranged by VISIT MOROCCO TOURS LTD, referred to as “VMT”.

1.2 VMT is a UK-incorporated travel business operating tours and travel services in Morocco.

1.3 VMT does not sell travel insurance and does not act as an insurer.

1.4 Unless expressly stated otherwise in the applicable Booking Confirmation, VMT does not include travel insurance within the price of a booking.

1.5 The absence of travel insurance does not remove any statutory rights or obligations applying to VMT.

2. Vmt Does Not Provide Travel Insurance

2.1 VMT does not provide insurance covering travellers against cancellation, illness, injury, baggage loss, personal belongings, travel interruption, medical evacuation or other personal travel risks.

2.2 VMT does not represent that any traveller is insured merely because the traveller has made a booking with VMT.

2.3 Travellers are responsible for arranging their own insurance.

2.4 VMT does not select, recommend, administer or underwrite a particular insurance policy unless expressly stated otherwise.

2.5 VMT does not guarantee the availability, suitability, validity or acceptance of any insurance policy.

3. Travel Insurance Recommendation

3.1 VMT strongly recommends that every traveller obtain comprehensive travel insurance before travelling to Morocco.

3.2 VMT recommends purchasing insurance immediately after booking where cancellation cover is desired.

3.3 Insurance should remain valid for the entire period of travel.

3.4 Travellers should check their policy before departure and before participating in activities.

3.5 Travellers should ensure that their policy covers the actual activities included in their booking.

5. Medical Insurance

5.1 VMT strongly recommends comprehensive medical insurance for travel in Morocco.

5.2 Travellers remain responsible for their own medical expenses unless VMT has a legal obligation to pay those expenses.

5.3 Travellers should ensure their insurance covers:

a. emergency treatment;

b. hospital treatment;

c. ambulance transportation;

d. specialist treatment;

e. medical evacuation;

f. repatriation;

g. pre-existing medical conditions where relevant.

5.4 Travellers with pre-existing medical conditions should disclose those conditions to their insurer where required by the insurance policy.

5.5 Failure to disclose a relevant condition might affect an insurance claim.

5.6 VMT is not responsible for an insurer's refusal to cover a medical expense.

6. Pre-Existing Medical Conditions

6.1 Travellers are responsible for checking whether their insurance covers pre-existing medical conditions.

6.2 Travellers should disclose relevant conditions to their insurer in accordance with the insurer's requirements.

6.3 VMT does not determine whether a traveller is medically fit to travel.

6.4 VMT does not determine whether an insurer will provide cover.

6.5 Where a medical condition materially affects the safe provision of an activity, the traveller should inform VMT before participation.

6.6 VMT will handle medical information according to its Privacy Policy and applicable data-protection requirements.

7. Cancellation Cover

7.1 VMT's cancellation terms apply independently of any insurance policy.

7.2 A traveller remains responsible for cancellation charges imposed under the applicable booking terms.

7.3 Travel insurance might reimburse some cancellation losses, depending on the policy.

7.4 VMT does not guarantee that an insurer will reimburse a cancellation charge.

7.5 Travellers wishing to protect themselves against cancellation costs should purchase suitable cancellation insurance promptly after booking.

7.6 Cancellation insurance should cover the full non-refundable value of the relevant booking where possible.

8. Curtailment

8.1 Travellers should consider curtailment insurance before travelling.

8.2 Curtailment cover might protect against losses arising when a traveller must end a trip early for an insured reason.

8.3 VMT does not provide curtailment insurance.

8.4 VMT does not guarantee reimbursement for unused services following early departure unless required by the booking terms or applicable law.

9. Medical Evacuation And Repatriation

9.1 Travellers should obtain insurance covering emergency medical evacuation and repatriation.

9.2 Some activities take place in rural or remote areas where specialist medical facilities might not be immediately accessible.

9.3 Medical evacuation might involve substantial costs.

9.4 VMT does not undertake to pay private medical evacuation costs unless VMT has a legal obligation to do so or expressly agrees otherwise.

9.5 Where VMT has an applicable statutory assistance obligation, VMT will comply with that obligation.

9.6 Where emergency assistance is provided by VMT, VMT does not thereby become the traveller's insurer.

9.7 Travellers remain responsible for their own insurance claims and policy excesses.

10. Adventure Activities

10.1 Travellers participating in activities with additional physical or environmental risks should ensure their insurance expressly covers those activities.

10.2 Relevant activities might include:

a. camel riding;

b. desert excursions;

c. sandboarding;

d. 4x4 excursions;

e. hiking;

f. trekking;

g. cycling;

h. water activities;

i. climbing;

j. other activities involving increased physical risk.

10.3 A standard travel policy might exclude certain activities.

10.4 Travellers are responsible for checking whether their chosen policy covers the specific activity.

10.5 VMT does not guarantee that a traveller's insurance covers an activity.

11. Contractually Required Insurance

11.1 VMT might require specific insurance for a particular service or activity.

11.2 Such a requirement will apply only where VMT clearly communicates it as a condition of the booking.

11.3 The Booking Confirmation or applicable activity terms will identify the required cover where reasonably practicable.

11.4 A traveller required to hold insurance must obtain appropriate cover before participating.

11.5 VMT might request reasonable evidence of required cover.

11.6 Where the traveller cannot demonstrate required insurance, VMT might refuse participation where the insurance requirement is a lawful and material condition of the activity.

11.7 In such circumstances, cancellation or non-participation consequences will depend on the applicable booking terms and the reason for non-participation.

11.8 VMT will not impose an insurance requirement merely to avoid a statutory obligation owed by VMT.

13. Traveller Responsibility

13.1 Each traveller is responsible for deciding whether they have adequate insurance.

13.2 Travellers must read their insurance policy before travel.

13.3 Travellers must check:

a. geographical coverage;

b. trip duration;

c. medical limits;

d. cancellation limits;

e. activity exclusions;

f. pre-existing condition requirements;

g. age restrictions;

h. excesses;

i. baggage limits;

j. personal liability cover;

k. evacuation arrangements;

l. exclusions relating to alcohol or unlawful conduct.

13.4 Travellers must comply with reasonable requirements imposed by their insurer.

13.5 VMT is not responsible for an insurer's refusal to pay a claim caused by the traveller's failure to comply with the insurance policy.

14. Alcohol, Drugs And Insurance

14.1 Travellers should understand that insurance policies often contain exclusions concerning alcohol, drugs, unlawful conduct and reckless behaviour.

14.2 VMT is not responsible for an insurer's refusal to cover a loss arising from an exclusion in the traveller's policy.

14.3 Traveller misconduct remains governed by VMT's Traveller Safety, Health and Activities Policy.

15. Lost Baggage

15.1 Travellers remain responsible for their personal baggage.

15.2 Travellers should obtain baggage insurance appropriate to the value of their belongings.

15.3 Travellers should comply with airline, transport-provider and accommodation security requirements where applicable.

15.4 VMT does not insure personal belongings.

15.5 Where VMT or a supplier has legal responsibility for a loss, the applicable liability rules remain unaffected.

16. Personal Belongings

16.1 Travellers should avoid carrying unnecessary valuables.

16.2 Travellers should keep important documents and valuables secure.

16.3 Travellers should retain receipts or other evidence of valuable items where their insurer requires such evidence.

16.4 VMT does not guarantee the security of personal belongings.

16.5 Any contractual or statutory liability of VMT remains subject to applicable law.

17. Insurance Claims

17.1 Travellers are responsible for making claims against their insurer.

17.2 VMT might provide reasonable documentation concerning a VMT service where appropriate.

17.3 Such assistance does not guarantee a successful insurance claim.

17.4 Travellers should notify their insurer promptly after an insured event.

17.5 Travellers should obtain supporting documentation where reasonably possible.

17.6 Such documentation might include:

a. receipts;

b. medical reports;

c. police reports;

d. cancellation confirmations;

e. supplier correspondence;

f. incident reports;

g. booking confirmations;

h. proof of payment.

17.7 VMT does not act as the traveller's insurance claims representative unless expressly agreed.

18. Vmt Assistance

18.1 Where reasonably possible, VMT might assist a traveller in identifying an appropriate supplier, medical provider, transport provider or local authority.

18.2 Assistance does not mean VMT accepts financial responsibility for the underlying expense.

18.3 VMT's assistance obligations are governed by the applicable booking terms and package-travel law.

18.4 Where VMT acts as a Package organiser, mandatory statutory assistance obligations remain applicable.

18.5 A traveller's insurance does not remove VMT's statutory obligations.

19. Vmt'S Role As Package Organiser

19.1 Where VMT acts as the organiser of a package within the meaning of applicable package-travel legislation, VMT remains responsible for the statutory obligations imposed on an organiser.

19.2 VMT cannot transfer those statutory obligations to the traveller merely by requiring travel insurance.

19.3 VMT cannot require a traveller to claim against their insurer instead of exercising a mandatory statutory right against VMT.

19.4 Where the law requires VMT to provide assistance, compensation, an alternative arrangement, a refund or another remedy, VMT will comply with that obligation.

19.5 Travel insurance operates alongside those statutory rights rather than replacing them.

The EU Package Travel Directive expressly provides protection concerning organiser insolvency and imposes organiser obligations concerning package performance.

20. Vmt'S Role As Intermediary

20.1 Where VMT acts solely as an intermediary or retailer rather than Package organiser, the contractual responsibility for the relevant individual travel service rests with the relevant supplier to the extent provided by applicable law.

20.2 The booking documentation will identify VMT's role where legally required.

20.3 Travellers should consider insurance regardless of whether VMT acts as organiser, retailer or intermediary.

21. Vmt Does Not Guarantee Insurance Cover

21.1 VMT does not guarantee that a traveller's insurance policy will cover:

a. illness;

b. injury;

c. cancellation;

d. curtailment;

e. delays;

f. baggage loss;

g. theft;

h. medical evacuation;

i. activity-related injury;

j. supplier failure;

k. natural events;

l. political events;

m. travel disruption.

21.2 Coverage depends on the traveller's individual insurance contract.

21.3 The insurer determines whether a claim is covered.

21.4 VMT is not responsible for differences between a traveller's expectations and the actual insurance policy.

24. Insurance And Traveller Conduct

24.1 A traveller remains responsible for losses caused by their own unlawful, reckless or deliberate conduct to the extent permitted by law.

24.2 VMT might seek reimbursement for damage or additional expenses caused by the traveller in accordance with the VMT Traveller Safety, Health and Activities Policy.

24.3 Travel insurance does not transfer responsibility for traveller-caused damage to VMT.

24.4 Travellers should check whether their personal liability insurance covers accidental damage caused to third parties.

25. Travel Insurance And Package Refunds

25.1 Insurance does not replace VMT's contractual or statutory refund obligations.

25.2 Where VMT is legally required to provide a refund, the traveller's failure to have insurance does not remove VMT's obligation.

25.3 Conversely, where VMT's terms lawfully permit a cancellation charge, the traveller cannot require VMT to waive that charge merely because the traveller did not purchase cancellation insurance.

25.4 A traveller might seek reimbursement of the cancellation charge from their insurer.

26. Insolvency Protection

26.1 Traveller insurance and package-travel insolvency protection are separate matters.

26.2 Where VMT acts as a Package organiser and UK package-travel legislation requires insolvency protection, VMT must maintain the legally required protection.

26.3 A traveller's travel insurance does not replace statutory insolvency protection.

26.4 VMT will not describe ordinary travel insurance as its insolvency protection.

26.5 VMT will provide legally required information concerning applicable financial protection.

The UK government confirms that Part 5 of the 2018 Regulations requires package organisers to obtain security covering foreseeable refunds and, where applicable, effective and prompt repatriation following insolvency.

This is the part I would NOT try to “word around”. If VMT is legally required to have insolvency protection for its package business, the policy cannot solve the problem through clever drafting.

27. No Vmt Travel Insurance

27.1 Unless expressly stated otherwise, VMT does not purchase individual travel insurance on behalf of travellers.

27.2 The booking price does not include traveller travel insurance.

27.3 Travellers remain responsible for arranging appropriate cover.

27.4 VMT does not receive an insurance premium from the traveller unless expressly stated in the booking.

28. Changes To Insurance Requirements

28.1 VMT might introduce an insurance requirement for a particular activity where a supplier, insurer, regulator or applicable law requires such cover.

28.2 VMT will communicate a new material requirement as soon as reasonably practicable.

28.3 VMT will not use a new insurance requirement to retrospectively deprive a traveller of rights already acquired under a confirmed contract.

29. Proof Of Insurance

29.1 Where insurance is contractually required, VMT might request reasonable evidence of cover.

29.2 VMT does not need to verify every term of a policy unless verification is reasonably necessary.

29.3 Providing a certificate does not guarantee that the policy satisfies every possible claim requirement.

29.4 The traveller remains responsible for ensuring adequate coverage.

30. Data And Insurance Information

30.1 VMT might receive limited insurance information where required for a booking or incident.

30.2 VMT will process such information in accordance with its Privacy Policy and applicable data-protection law.

30.3 VMT will not request medical or insurance information which is unnecessary for the relevant purpose.

31. Applicable Law

31.1 This Policy operates together with VMT's Customer Terms and Conditions, VMT Package Travel and Travel Services Policy and VMT Traveller Safety, Health and Activities Policy.

31.2 Mandatory UK, EU, Moroccan, US or other applicable consumer protection requirements prevail where applicable.

31.3 Nothing in this Policy excludes a mandatory statutory right.

32. Effective Date

32.1 This Policy takes effect on 12 August 2026.

32.2 VMT may review and update this Policy following changes in legislation, regulatory requirements, supplier requirements or business operations.

32.3 The version applicable to a confirmed booking forms part of the contractual documentation, subject to mandatory legal requirements.
